Absolute Divorce

Getting an absolute divorce may be one the easiest parts of dissolving your marriage.
In the state of North Carolina you must be separated for one year. This means you must live under two separate roofs continuously for one year with the intent, by at least one spouse, to end the marriage. There are three ways our firm may obtain your divorce:


1) Divorce Before the Clerk. This is the fastest way to obtain a divorce. If your spouse will cooperate with us and there are no issues attached to your divorce (child support, custody, ....etc) you may be able to obtain your divorce within two weeks. You will not need to be in Court to obtain the divorce.

2) Summary Judgment. This will take at least 45 days from the day your spouse receives the divorce paperwork (Complaint and Civil Summons). You will not need to be in Court to obtain the divorce.

3) Hearing. This will take at least 35 days from the day your spouse receives the divorce paperwork to obtain. You will need to come to court to testify. The Court does not care to hear the details of why you want the divorce. The Courts only concern is whether you meet the statutory requirements listed above.
